3. OUR BUSINESS

The Mall LPL LTD is an independent UK retailer specialising in trading card games, collectibles and related products.

We sell products from a range of trading card games, manufacturers, languages and international markets.

Products may include English, Japanese, Korean, Simplified Chinese and other regional or international releases.

Where relevant, product listings identify important characteristics such as language, region, product type, contents and condition.

We currently accept website orders for delivery to United Kingdom addresses only.

4. INDEPENDENT RETAILER

The Mall LPL LTD is an independent retailer.

Unless expressly stated otherwise, we are not affiliated with, sponsored by, endorsed by or acting on behalf of the manufacturers, publishers, licensors or brand owners whose products we sell.

Brand names, product names, characters, logos, artwork and trademarks remain the property of their respective owners.

Their use on TheMallLPL.com is for the purpose of identifying and describing products offered for sale.

We do not claim to be an official, authorised or certified retailer, distributor or partner of any particular brand unless such a relationship is expressly stated and can be substantiated.

5. PRODUCT AUTHENTICITY

The Mall LPL LTD is committed to selling genuine products.

Products described as genuine, official, branded or factory sealed are offered on that basis and are sourced through suppliers, distributors and other legitimate commercial supply channels.

We do not knowingly sell counterfeit, replica or imitation trading card products as genuine branded products.

If you have a concern about the authenticity of a product purchased from us, please contact:

support@themalllpl.com

We will investigate the concern and take appropriate action where necessary.

Nothing in this section affects your statutory rights where goods are not as described or otherwise fail to meet applicable legal requirements.

6. USING OUR WEBSITE

You may use TheMallLPL.com only for lawful purposes.

You must not:

- Use the website for fraudulent or unlawful purposes
- Attempt to gain unauthorised access to our website, accounts, systems or servers
- Introduce viruses, malware or other malicious material
- Interfere with the security or operation of the website
- Use another person's identity or payment information without authorisation
- Submit deliberately false or misleading information
- Use our branding in a way that falsely suggests an association with The Mall LPL LTD
- Use automated systems to extract substantial amounts of website content without permission where such activity is not otherwise permitted by law

We may take reasonable action to protect our website, customers and business against fraudulent, abusive, unlawful or malicious activity.

7. CUSTOMER ACCOUNTS

Certain website features may allow or require you to create a customer account.

You are responsible for:

- Providing accurate information
- Keeping your account information current
- Maintaining the confidentiality of your login credentials
- Taking reasonable steps to prevent unauthorised use of your account

If you believe your account has been accessed without permission, please contact us promptly at:

support@themalllpl.com

We may suspend or restrict an account where reasonably necessary to protect customers, our business, our website or other users from suspected fraud, misuse or security threats.

8. PRODUCT INFORMATION

We take reasonable care to ensure that our product titles, descriptions, specifications, images, prices, availability and other information are accurate.

However:

- Colours may appear differently depending on your screen or device
- Manufacturers may update packaging or presentation
- International editions may have different packaging from UK releases
- Packaging may vary between production runs
- Blind, mystery or randomised products may vary as described in their listings
- Representative images may occasionally be used where this is made clear
- Minor packaging variations may occur

Where a product listing specifies a particular language, edition, quantity, condition or product type, we aim to supply the product as described.

If we discover a material error affecting an order, we will take reasonable steps to contact you and provide an appropriate resolution.

9. INTERNATIONAL AND FOREIGN-LANGUAGE TCG PRODUCTS

We sell trading card products manufactured for a number of different markets.

These may include:

- English-language products
- Japanese-language products
- Korean-language products
- Simplified Chinese-language products
- Other international or regional releases

A product being manufactured for a market outside the United Kingdom does not by itself mean that it is unofficial or counterfeit.

Customers should review the product title, description, language, images and specifications carefully before ordering.

Where relevant, we aim to clearly identify the language or regional edition of a product before purchase.

10. FACTORY-SEALED PRODUCTS

Where a product is described as "factory sealed", this means that the external product is supplied in the manufacturer's sealed condition applicable to that product.

Trading cards within factory-sealed products are manufactured, printed, cut, packed and sealed by the relevant manufacturer.

Individual cards are mass-manufactured and may display normal manufacturing or packaging variations.

These may include:

- Centring differences
- Print lines
- Minor surface marks
- Edge imperfections
- Corner imperfections
- Cutting variations
- Minor whitening
- Print or colour variations
- Other normal manufacturing characteristics

A manufacturing variation affecting an individual card does not automatically mean that the sealed product supplied by The Mall LPL LTD was faulty or not as described.

Any genuine claim concerning faulty, damaged or misdescribed goods will be assessed in accordance with applicable consumer law and our Returns & Refunds Policy.

11. CARD GRADING

Unless expressly stated otherwise on the relevant product listing, we do not guarantee any professional grading result for cards obtained from sealed trading card products.

This includes grades issued by PSA, BGS / Beckett, CGC, Ace Grading or any other professional grading company.

A card being obtained directly from a factory-sealed product does not guarantee:

- Gem Mint condition
- PSA 10
- BGS 10
- CGC 10
- Perfect centring
- Perfect surfaces
- Perfect corners
- Perfect edges
- Any other particular grading outcome

Professional grading companies operate independently and apply their own standards and opinions.

A card failing to achieve, or being unlikely to achieve, a particular professional grade does not by itself establish that the sealed product supplied by The Mall LPL LTD was faulty or misdescribed.

Nothing in this section affects your statutory rights where goods are genuinely faulty or not as described.

12. RANDOMISED PRODUCTS, CARDS AND PULLS

Many trading card products contain randomised contents.

Unless expressly stated otherwise on the product listing or guaranteed by the manufacturer, purchasing a randomised trading card product does not guarantee any particular:

- Card
- Character
- Artwork
- Rarity
- Chase card
- Hit
- Pull rate
- Monetary value
- Collection outcome
- Professional grading result

The absence of a particular card, rarity or desired pull does not by itself mean that a genuine randomised trading card product is faulty.

Where a manufacturer specifically guarantees particular contents, we aim to describe those guaranteed contents appropriately.

13. PRICES

All consumer prices displayed on TheMallLPL.com are in Pounds Sterling (GBP / £).

Where applicable, consumer prices displayed on our website include VAT.

Delivery charges, where applicable, are displayed during checkout before you complete your purchase.

The total amount payable will be shown before you submit and pay for your order.

Prices may change from time to time.

Changing a price on our website will not retrospectively change the price of an order for which a binding contract has already been formed, except where otherwise permitted by law.

14. PROMOTIONS AND DISCOUNTS

We may occasionally offer discounts, promotional codes, bundles or other promotions.

Promotions may:

- Apply for a limited period
- Apply only to specified products
- Require a minimum order value
- Be limited to one use per customer
- Have other clearly stated conditions

Any specific promotional conditions displayed with an offer form part of that promotion.

We reserve the right to end or amend future availability of a promotion, but this will not retrospectively remove rights already arising from a completed qualifying purchase.

15. PLACING AN ORDER

When you place an order through TheMallLPL.com, you are offering to purchase the products in your basket.

Before placing your order, you should check:

- The products selected
- Quantities
- Product language or edition where relevant
- Delivery address
- Billing information
- Delivery method
- Total price

You are responsible for ensuring that information supplied during checkout is accurate.

After placing an order, you should receive an electronic acknowledgement or confirmation.

An automated acknowledgement that we have received your order does not necessarily mean that we have accepted the order.

16. WHEN A CONTRACT IS FORMED

Unless we expressly state otherwise, a binding contract for the sale of physical goods is formed when we accept your order, normally when the order is confirmed for fulfilment or dispatched.

If we cannot accept your order, we will notify you and, where payment has already been taken, arrange an appropriate refund.

Reasons we may be unable to accept an order can include:

- A product unexpectedly becoming unavailable
- An obvious material pricing or listing error
- Inability to authorise payment
- Suspected fraudulent activity
- Delivery restrictions
- A technical or inventory error
- Circumstances preventing lawful fulfilment

We will not cancel an accepted consumer order arbitrarily where doing so would conflict with your legal rights.

17. PAYMENT

Payment must be made using a payment method available through our checkout.

Payments are processed through Shopify and/or the relevant payment provider.

By submitting payment information, you confirm that you are authorised to use the payment method provided.

We may take reasonable steps to verify or protect transactions against fraud.

Your payment provider may apply its own terms and security procedures.

18. ORDER AVAILABILITY

All products are subject to availability.

Adding an item to your shopping basket does not reserve it.

Although we take reasonable steps to maintain accurate inventory information, occasional discrepancies can occur.

If a product becomes unavailable after you order it, we will contact you and provide an appropriate resolution.

If we cannot fulfil an item for which payment has been taken, we will refund the applicable amount.

19. SHIPPING AND DELIVERY

We currently deliver website orders to addresses within the United Kingdom only.

Our standard order processing time is normally 1–2 working days.

Our primary delivery service is normally Royal Mail Tracked 48, which will usually take approximately 2–3 working days after dispatch.

This means a typical order should normally arrive within approximately 3–5 working days from successfully placing the order, although delivery times are estimates unless we expressly agree a guaranteed delivery date.

Delivery charges are displayed during checkout before payment.

Full information is available in our Shipping & Delivery Policy.

20. RESPONSIBILITY DURING DELIVERY

We use third-party delivery providers to deliver orders.

Using a delivery provider does not remove or restrict your statutory rights against The Mall LPL LTD as the retailer.

Risk in goods will pass to you when the goods come into your physical possession, or into the physical possession of a person identified by you to take possession of them, except where applicable law provides otherwise.

If an order is genuinely lost or damaged during delivery, please contact us.

We will investigate the matter and provide an appropriate remedy in accordance with the circumstances and your statutory rights.

Please see our Shipping & Delivery Policy for further information.

21. DELIVERY ADDRESS

You are responsible for checking that your delivery address is accurate before submitting an order.

If you notice an error, contact us as soon as possible:

support@themalllpl.com

If the order has not yet been dispatched, we will make reasonable efforts to correct the address.

We cannot guarantee that delivery information can be changed after an order has entered fulfilment or has been handed to the carrier.

Where an order is returned because an incorrect or incomplete address was supplied by the customer, reasonable additional delivery costs may apply to redispatch.

This does not affect your statutory rights.

22. CANCELLATIONS, RETURNS AND REFUNDS

Your rights regarding cancellations, returns, refunds, damaged goods and faulty products are explained in our Returns & Refunds Policy.

For eligible online purchases, consumers normally have a legal right to change their mind and cancel within 14 days after receiving the goods, subject to applicable exceptions.

Nothing in these Terms or our Returns & Refunds Policy excludes or restricts your statutory rights.

Please contact us before sending a return so that we can provide the appropriate return instructions.

Email:

support@themalllpl.com

23. OPENED TRADING CARD PRODUCTS

Opening factory-sealed trading card products, booster packs, collection boxes or other randomised products may significantly reduce or eliminate their resale value.

If goods are opened, unsealed, used or handled beyond what would reasonably be necessary to establish their nature, characteristics and condition, this may affect the amount refundable on a change-of-mind return where permitted by applicable law.

Opening a product does not remove statutory rights where goods are genuinely faulty, damaged, incorrectly supplied or not as described.

Please refer to our Returns & Refunds Policy for complete information.

24. FAULTY OR NOT-AS-DESCRIBED GOODS

Goods supplied by The Mall LPL LTD must meet the standards required by applicable UK consumer law.

If goods are genuinely:

- Faulty
- Damaged
- Incorrectly supplied
- Not as described
- Otherwise not compliant with applicable statutory requirements

you may be entitled to remedies under consumer law.

Please contact:

support@themalllpl.com

Nothing in these Terms limits or excludes those statutory rights.

25. PRE-ORDERS

Products offered as pre-orders will be identified as such on the relevant product listing.

Any release or expected dispatch date is based on information available to us from manufacturers, distributors or suppliers and may occasionally change.

Where a release date changes, we will fulfil the order using the updated release information available to us.

Pre-orders may generally be cancelled before dispatch in accordance with our Returns & Refunds Policy.

If we are unable to fulfil a pre-order, we will provide an appropriate refund.

Once a physical pre-order has been dispatched, the normal cancellation and return provisions apply, subject to applicable law.

26. RETAIL STORE AND ONLINE PRICING

Prices and promotions offered through TheMallLPL.com may occasionally differ from prices or promotions available:

- In our physical retail store
- During live-selling events
- Through third-party marketplaces
- At events or conventions
- Through other sales channels

This can occur because different channels may have different costs, fees, promotions or commercial arrangements.

The price applicable to a website purchase is the price clearly displayed and agreed during the website checkout process.

27. INTELLECTUAL PROPERTY

Original content created and owned by The Mall LPL LTD may include:

- The Mall branding
- Original written content
- Original product descriptions
- Original photographs
- Original graphics
- Promotional material
- Website content
- Other original creative material

Such content is owned by or licensed to The Mall LPL LTD and may be protected by applicable intellectual property laws.

Third-party trademarks, product artwork, characters, logos and other intellectual property remain the property of their respective owners.

Their appearance on our website does not transfer ownership to The Mall LPL LTD.

You must not reproduce, republish, distribute or commercially exploit content owned by The Mall LPL LTD without permission except where permitted by law.

28. REVIEWS, FEEDBACK AND CUSTOMER CONTENT

If you voluntarily submit a product review, photograph, comment, suggestion or other content to us or through functionality provided on our website, you confirm that you have the right to provide that content.

You must not submit content that is:

- Unlawful
- Fraudulent
- Defamatory
- Threatening
- Abusive
- Infringing another person's intellectual property
- Deliberately misleading
- Malicious
- Containing harmful software or code

Where you submit content for publication, you grant us a non-exclusive, royalty-free licence to display and use that content for operating and promoting our business, subject to applicable law and our Privacy Policy.

We may remove content where reasonably necessary because it breaches these Terms or applicable law.

29. THIRD-PARTY LINKS

Our website may contain links to websites operated by third parties.

These links may include manufacturers, social-media platforms, payment providers, delivery providers or other external services.

Unless expressly stated otherwise, providing a link does not mean that we own, operate, control or endorse the third-party website.

Third-party websites operate under their own terms, policies and privacy practices.

30. SHOPIFY

TheMallLPL.com is powered by Shopify.

Shopify provides the ecommerce technology that enables us to operate our online store.

Any purchase you make from TheMallLPL.com is a transaction between you and The Mall LPL LTD as the retailer.

Shopify provides technology and related services but is not the seller of the physical products purchased from The Mall LPL LTD.

Certain information may be processed by Shopify as described in our Privacy Policy and Shopify's applicable privacy information.

31. PRIVACY AND DATA PROTECTION

We process personal information in accordance with our Privacy Policy and applicable UK data-protection law.

Our Privacy Policy explains:

- What information we collect
- Why we process it
- Our lawful bases
- Who information may be shared with
- International data transfers
- Retention
- Cookies
- Your data-protection rights

Please review our Privacy Policy for further information.

32. WEBSITE AVAILABILITY

We aim to keep TheMallLPL.com available and operating correctly.

However, temporary interruptions may occur because of:

- Maintenance
- Technical problems
- Security issues
- Hosting or platform disruption
- Updates
- Circumstances outside our reasonable control

We may make reasonable changes to our website from time to time.

Nothing in this section excludes liability or consumer rights that cannot legally be excluded.

33. ERRORS AND INACCURACIES

Despite our efforts to maintain accurate information, occasional errors may occur.

These could relate to:

- Product descriptions
- Product specifications
- Prices
- Availability
- Promotions
- Delivery information
- Images

We reserve the right to correct genuine errors when identified.

Where a material error affects an order you have placed, we will deal with the matter fairly and in accordance with applicable law.

Nothing in this section gives us an unrestricted right to change an agreed consumer contract retrospectively.

34. LIMITATION OF LIABILITY

Nothing in these Terms excludes or restricts liability where doing so would be unlawful.

In particular, nothing in these Terms excludes or restricts liability for:

- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Breach of statutory rights relating to goods
- Goods that are not as described
- Goods that are not of satisfactory quality where applicable
- Any other liability that cannot legally be excluded or restricted

Nothing in these Terms is intended to remove or reduce the statutory rights available to consumers.

Where permitted by law, we will not be responsible for losses that were not reasonably foreseeable as a result of our breach or for losses relating to business activity where you entered into the contract wholly as a consumer.

Different limitations may apply where products are purchased wholly for business purposes.

35. EVENTS OUTSIDE OUR REASONABLE CONTROL

There may be circumstances outside our reasonable control that temporarily prevent or delay performance of our obligations.

Examples may include:

- Severe weather
- Major carrier disruption
- Industrial action
- Widespread technical or communications failures
- Natural disasters
- Government restrictions
- Other exceptional events outside our reasonable control

Where such an event affects an order, we will take reasonable steps to minimise disruption and communicate with affected customers where appropriate.

Nothing in this section removes any statutory right you have to cancel, obtain a refund or exercise another remedy where applicable.

36. TERMINATION OR RESTRICTION OF WEBSITE ACCESS

We may restrict or suspend access to our website or a customer account where reasonably necessary because of:

- Fraud
- Suspected fraudulent activity
- Security threats
- Unlawful conduct
- Material misuse of our website
- Serious or repeated breach of these Terms

Restricting website or account access does not remove any existing statutory rights relating to orders already placed.

37. SEVERABILITY

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue to apply.

38. NO WAIVER

If we do not immediately exercise a right available to us under these Terms, this does not necessarily mean that we have waived that right.

Similarly, nothing in these Terms prevents you from exercising statutory rights available to you.

39. CHANGES TO THESE TERMS

We may update these Terms from time to time to reflect changes to:

- Our business
- Our website
- Our products or services
- Applicable laws or regulations
- Our policies

The latest version will be published on this page with an updated revision date.

Changes will not retrospectively remove statutory rights or contractual rights that have already arisen.

40. GOVERNING LAW

These Terms and contracts for purchases through TheMallLPL.com are governed by applicable UK law.

Where English law applies, these Terms will be interpreted accordingly.

Nothing in this section prevents a consumer from exercising any right to bring proceedings in a court available to them under applicable consumer or jurisdiction law.

41. RELATED POLICIES

These Terms should be read alongside our other website policies, including:

- Returns & Refunds Policy
- Shipping & Delivery Policy
- Privacy Policy
- Contact Information
- Legal Notice

Where a specific policy provides more detailed information about a particular matter, that policy should be read together with these Terms.

Nothing in any policy excludes statutory consumer rights.
